These Terms & Conditions apply to all sales of products by Rowley Produce ("we", "us", "our") to the customer ("you", "your") within the United Kingdom. Any variation to these Terms & Conditions must be agreed in writing by Rowley Produce.

By placing an order with Rowley Produce, you agree to be bound by these terms and conditions.

1. About Us

1. 1 Rowley Produce is a local farm shop supplying fresh meat, produce, and related products within the UK.

1. 2 Many products are fresh, seasonal, prepared to order, or sourced specifically for customer requirements. As a result, availability, appearance, size, weight, and prices may vary slightly.

2. Ordering & Processing

2. 1 You must be at least 18 years of age to place an order.

2. 2 Orders can be placed via the website or in person.

2. 3 Orders for the next available collection or delivery date must be placed no later than 9:00pm on the Wednesday before.

2. 4 Orders placed after the stated cut-off time may instead be processed for the following available collection or delivery date.

2. 5 Orders containing chicken products must be placed at least 5 days in advance and no later than 9:00pm on the Sunday before the relevant collection or delivery cut-off date to allow for sourcing and preparation.

2. 6 Submission of a pre-order does not guarantee acceptance or availability of products. All orders are subject to confirmation by Rowley Produce based on product availability, seasonal supply, and operational capacity.

3. Pricing & Weights

3. 1 Products are priced by weight (per kilogram), quantity, or individual listing, depending on the product.

3. 2 As our products are fresh and prepared to order, weights and quantities may vary.

3. 3 While we make every effort to meet requested weights, quantities, or specifications, exact amounts cannot always be guaranteed. Customers may therefore receive the product or quantity that most closely matches their requested requirements, which may affect the final price.

3. 4 Final prices are confirmed at the time of collection or delivery once items have been weighed, prepared, and packed.

4. Amendments

4. 1 Requests to amend an order must be made before 9pm on the Wednesday prior to your collection or delivery date.

4. 2 Amendment requests must be made in writing via the website contact form.

4. 3 Amendment requests submitted after the stated cut-off time may not be possible due to product preparation, packing, sourcing, or stock availability.

4. 4 Rowley Produce will confirm whether any requested amendment can be accepted.

4. 5 Any accepted amendment may affect the final price.

5. Cancellations

5. 1 Orders must be cancelled no later than 7 days before the scheduled collection or delivery date.

5. 2 Failure to provide the required notice will result in the customer being liable for the full cost of the order.

5. 3 Cancellation requests must be made in writing via the website contact form.

5. 4 Orders containing specially sourced items may not be cancelled once confirmed by Rowley Produce.

6. Unavailable Items

6. 1 All products are subject to availability.

6.2 Due to seasonal supply, stock, availability, and sourcing limitations, certain products may become unavailable after a pre-order has been submitted.

6. 3 Where an item becomes unavailable, Rowley Produce will notify the customer to discuss a suitable alternative, amendment, or removal from the order.

6. 4 Where products cannot be reasonably supplied, Rowley Produce may amend or remove affected items from the order.

7. Collection of Items

7. 1 Order collections are available during Rowley Produce Farm Shop opening hours Friday: 2:00pm - Saturday 10:00am - 2:00pm (except the first Saturday of the month)

7. 2 Orders must be collected on your agreed collection date

7. 3 Customers who are unable to collect their order should contact Rowley Produce as soon as possible to discuss alternative arrangements.

7. 4 Alternative collection arrangements may be offered subject to availability.

7. 5 Failure to collect an order without prior notice may result in this being treated as a cancellation, and the customer remaining liable for the full cost of the order.

7. 6 Uncollected orders may be resold where possible or otherwise disposed of in accordance with food safety requirements.

8. Delivery of Items

8. 1 Minimum Order

8. 1. 1 Orders for delivery require a minimum spend of £30.00.

8. 2 - Local Deliveries

8. 2. 1 Local delivery orders are delivered on Tuesdays only.

8. 2. 2 Local delivery may be offered directly by Rowley Produce, subject to availability and location.

8. 2. 3 Delivery is currently available within the following postcode areas:

HULL: HU1, HU2, HU3, HU4, HU5, HU6 & HU7

EAST YORKSHIRE: HU13, HU14, HU15, HU16, HU17, YO42 & YO43

8. 2. 4 A delivery charge of £2.50 applies per order.

8. 2. 5 Someone must be available to receive the delivery on the agreed date within the given time window. For food safety reasons, orders cannot be left in a safe place.

8. 2. 6 Payments can be made by cash or card at the time of delivery.

8. 3 Third-Party Courier Services

8. 3. 1 Where local delivery is unavailable, orders may be sent via a third-party courier service (such as DPD), subject to suitability of the products ordered.

8. 3. 2 Full payment must be received prior to dispatch for all courier deliveries.

8. 3. 3 Responsibility for the order passes to the customer once the order has been dispatched to the courier.

8. 3. 4 Rowley Produce is not responsible for delays or issues caused by third-party courier services once an order has been dispatched. If an order is received in an unacceptable condition, the customer must contact Rowley Produce within 24 hours so the matter can be reviewed appropriately.

8. 3. 5 Courier delivery charges may vary depending on the size, weight and type of products ordered.

8. 4 Right to Decline Delivery

8. 4. 1 Rowley Produce reserves the right to decline delivery where necessary.

9. Refunds & Returns

9. 1 Due to the perishable nature of fresh food products, the return of items is not permitted under the Consumer Contracts Regulations once products have been prepared, packed, processed or dispatched, unless goods are faulty, unsafe, damaged, or not as described.

9. 2 Where appropriate, Rowley Produce may offer a replacement, refund, partial refund, or other reasonable resolution depending on the circumstances and product availability.

9. 3 Concerns relating to product quality that could not have reasonably been identified at the point of collection or delivery must be reported within 30 days of receipt, together with clear details of the issues and supporting evidence or photographs where appropriate.

9. 4 Any approved refund will be issued using the original payment method unless otherwise agreed.

10. Product Quality

10. 1 Rowley Produce will comply with all applicable UK legislation, including but not limited to food safety, hygiene, labelling and traceability requirements.

10. 2 Rowley Produce warrants that all products meet applicable food safety standards at the point of collection or delivery.

10. 3 We take pride in supplying high-quality, fresh, hand-reared or locally sourced produce.

10. 4 Natural variations in size, colour, fat content, and appearance are normal and do not constitute a fault.

10. 5 If you believe an item does not meet acceptable standards, please contact us within a reasonable time-frame so we can review the issue fairly.

10. 6 Product appearance may vary from illustrations, photographs, or images shown online.

11. Customer Responsibilities

11. 1 Responsibility for products passes to the customer upon full payment and collection or delivery of the order.

11. 2 Customers are responsible for inspecting products upon collection or delivery and must notify Rowley Produce within 24 hours of any shortages, incorrect items, visible defects, or quality concerns identifiable upon receipt.

11. 3 Customers are responsible for complying with any applicable laws, regulations, or procedures relating to the storage, handling, preparation, resale, or use of products following collection or delivery.

11. 4 Failure to follow appropriate storage, refrigeration, freezing, preparation, or handling guidance may affect product quality and safety. Rowley Produce cannot accept liability for issues arising after collection or delivery where products have not been stored or handled appropriately.

12. Right to Refuse Service

12. 1 We reserve the right to refuse or cancel orders, refuse delivery or collection, or decline future service where reasonably necessary.

12. 2 This may include, but is not limited to:

  • Abusive, threatening, or inappropriate behaviour towards staff

  • Repeated failure to collect orders

  • Repeated late cancellations or failed delivery attempts

  • Non-payment for orders

  • Abuse of Rowley Produce's Terms & Conditions

  • Providing false, misleading, or inaccurate information

  • Circumstances where Rowley Produce believes fulfilment of the order would be unreasonable or unsafe

13. Limitation of Liability

13. 1 Rowley Produce shall not be liable for any indirect, consequential, or business-related losses, including loss of profit, loss of business, or business interruption arising from the supply of products or services.

13. 2 Rowley Produce's total liability in relation to any order shall not exceed the total value of the products supplied under that order.

13. 3 Nothing within these Terms & Conditions excludes or limits liability where it cannot legally be excluded under applicable law.

14. Force Majeure

14. 1 Rowley Produce shall not be held responsible for any delay, failure, or inability to fulfil orders due to circumstances beyond our reasonable control, including but not limited to severe weather, disease outbreaks, transport disruptions, equipment failure, supplier shortages, or other unforeseen events affecting operations or supply.

15. Data Protection

15. 1 Rowley Produce will handle and process customer information in accordance with applicable UK data protection laws.

15. 2 Customer information may be used for the purposes of processing orders, arranging collection or delivery, communicating with customers, and maintaining business records.

15. 3 Rowley Produce will not knowingly share customers' personal information with third parties except where necessary to fulfil orders, arrange delivery, comply with legal obligations, or where consent has been provided.

15. 4 Customers purchasing products for business, commercial, or resale purposes are responsible for ensuring their own compliance with applicable UK data protection laws where personal data is processed or shared.

16. Governing Law

16. 1 These Terms & Conditions shall be giverned by and interpreted in accordance with the laws of England and Wales.

16. 2 Any disputes arising in relation to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to These Terms

17. 1 We may update these Terms & Conditions at any time.

17. 2 The version displayed on our website at the time of ordering will apply.

18. Enquiries, Feedback & Complaints

18. 1 Customers may contact Rowley Produce regarding orders, enquiries, feedback, complaints, amendments, cancellations, or other general matters using the website contact form or telephone - 07946 896504

18. 2 Complaints regarding services or matters unrelated to product quality should be raised with Rowley Produce within a reasonable timeframe to allow the matter to be investigated properly.
